INSURANCE COMPANIES ARE LOBBYING TO CHANGE THE ACT'S MOTOR INJURY COMPENSATION LAWS

The changes will give insurance companies even more power over medical and compensation decisions for people injured in a road accident.

Under the changes, insurance companies will be able to:

Deny medical expenses, even if they're recommended by your doctor.

Reduce your rights to appeal their decisions and make it harder to get independent legal advice about your rights.

Severely restrict your access to compensation and lower the compensation you would currently be entitled to.

Restrict access Workers Compensation for workers who are injured on the road while they're at work.

The insurance companies are trying to change the road injury compensation laws even more in their favour. 

If they get their way, the insurance companies will have even more power, at the expense of everyday people.

Under the changes they want, insurance companies will be able to make injured people see the company's preferred doctors and health specialists, not your own doctor. 

They'll also be able to determine your 'recovery plan' that determines what expenses and medical treatments you can access, even if you don't agree with it.

Your rights to appeal the insurance company's decisions will also be limited. If you disagree with a decision, your appeal with go to an internal reviewer within the insurance company. 

You'll also be prevented from appealing decisions to the courts like you currently can, unless you go through the internal appeal system that is rigged in favour of the insurance company you're appealing against.

Why are the insurance companies trying to make these changes?

 

Because they think they can get away with it, and because as the Royal Commission demonstrated, they care more about profits than people.

Reducing compensation rights, access to appeals and gaining greater power to deny medical expenses will significantly increase the profits of insurance companies.

In other states and territories where similar changes were made to accident compensation laws, insurance company profits increased from 11% to over 30% in come cases. 

The insurance companies know that they can pocket increased profits without needing to significantly reduce the insurance premium that gets charged with your car registration.

What's more, they'll be able to increase their premiums each year by at least 3%, which is above cost of living increases.

Just a few decades ago, insurance companies used to be about helping the people who had insurance policies. 

But now, some of the largest and most profitable corporations in Australia are insurance companies. They've used their power to re-write many of the compensation schemes in other states and territories, boosting their profits and their power even more.

Now, most Governments are scared of insurance companies, and get intimidated into reducing the rights of everyday people by changing compensation laws.

Anyone who drives a car or bike to work, or uses a vehicle of any kind for their work will be affected by these proposals.

That includes workers who regularly drive for work, as well as when you drive or ride to and from work.

The Royal Commission has already shown that insurance companies will do whatever it takes to make money from unsuspecting victims. 

They’ve been found to be taking premiums from people who are deceased and selling junk insurance products (insurance policies that can never be claimed) to their customers. 

These companies are driven by greed, not by people’s welfare. They cannot be trusted to serve the interests of their customers and therefore should never be handed these additional powers.

This campaign is run by UnionsACT, the representative voice of the trade union movement in the Canberra region, representing 33,000 members. 

Unions are running this campaign because we are concerned that the changes to road injury compensation laws undermine and reduce the rights of working people. 

In particular, insurance companies and big business lobby groups have been trying for years to reduce compensation rights for workers. Now, they are trying to do it by stealth, through motor injury compensation. 

We know that if the insurance companies are successful in reducing workers' rights for road accidents, they'll try to wreck workers compensation too.
